Pre-Existing Injury Lawyer, Simi Valley, CA
A pre-existing injury or condition is an injury or condition that you had before starting a job. These types of injuries and conditions are not eligible because they are not necessarily job-related. If you have had an injury or condition in the past, it is suggested to let your employer know, before you start, especially if that injury or condition may be something that your job aggravates. It is always better to be safe than sorry.
Pre-existing Injury Injuries are physical ailments that affect different parts of your body. These injuries can be related to your arms, legs, neck, back or head or any other body part. If you have had any sort of major injury in your life, that your current job might spur on, you need to let someone know. For example, if you’ve had a wrist break in your life, and your current job is one where you are constantly using your hands and wrists (to type, lets say), if you end up being injured further, it is not your works fault. Pre-existing Condition Conditions are commonly referred to as internal issues. These types of things can be ailments such as: asthma, cancer, respiratory diseases and stress. If you have had any of these conditions before starting a job, it’s a good idea to let your HR department know. If you, for instance, have had asthma your whole life and the job you are working is one that requires you to be on the move, for hours a day, and then you start to have breathing issues, this is not your company’s fault. You need to be aware that conditions you already have, are not your job’s responsibility to fix. Not Eligible Because pre-existing injuries and conditions are things that you had well before you started your job, it is not up to your job to fix them. If any injury or condition you are experiencing is an exasperation of an old injury or condition, it is not eligible for workers compensation. If you think about it, why should your work have to pay you for an injury or condition that they did not cause you to have? Logically, this is not fair.
